    1. Purpose, Scope, and Contractual Status<\/b><\/strong><\/li><\/ol>

      This Booking & Cancellation Policy (\u201cPolicy<\/b><\/strong>\u201d) governs booking, payment, cancellations, rescheduling, refunds, and disputes for date-specific leisure services (\u201cActivities<\/b><\/strong>\u201d) offered by:<\/p>

      This Policy forms an integral part of your contract with WYND and must be read together with the Website Terms & Conditions<\/b><\/strong>.<\/p>

      1. Nature of Activities (Date-Specific Leisure Services)<\/b><\/strong><\/li><\/ol>

        Activities are provided on fixed dates or within fixed periods. WYND commits capacity and operational resources in advance (crew, vessel\/venue, suppliers). Therefore:<\/p>

        • bookings are capacity-limited<\/b><\/strong>,<\/li>
        • cancellation rules are strict,<\/li>
        • last-minute refunds are generally not possible.<\/li><\/ul>

          \u00a0<\/p>

          1. Booking Process and Contract Formation<\/b><\/strong><\/li><\/ol>

            3.1 Booking Request<\/b><\/strong>
            A booking request can be submitted via the Platform or in writing (email).<\/p>

            3.2 Booking Confirmation<\/b><\/strong>
            A binding contract is concluded only when WYND issues a written booking confirmation (email\/portal confirmation).<\/p>

            3.3 Acceptance \/ Refusal<\/b><\/strong>
            WYND may refuse booking requests for capacity, safety, compliance, or community integrity reasons.<\/p>

            1. Inclusions and Exclusions<\/b><\/strong><\/li><\/ol>

              4.1 Included Services<\/b><\/strong>
              Inclusions are stated in the Activity description and booking confirmation.<\/p>

              4.2 Exclusions (Unless Explicitly Included)<\/b><\/strong>
              Typically excluded:<\/p>

              • flights\/transport to\/from destination,<\/li>
              • visas\/permits\/vaccinations,<\/li>
              • insurance (travel, health, cancellation),<\/li>
              • personal expenses,<\/li>
              • optional add-ons not listed as included.<\/li><\/ul>

                \u00a0<\/p>

                1. Prices, Currency, Taxes, and Fees<\/b><\/strong><\/li><\/ol>

                  Prices are shown in the booking flow. Unless explicitly stated:<\/p>

                  • you bear bank\/FX fees,<\/li>
                  • third-party processing fees may apply,<\/li>
                  • local taxes or fees may be charged depending on destination\/service design.<\/li><\/ul>

                    \u00a0<\/p>

                    1. Payment Terms<\/b><\/strong><\/li><\/ol>

                      6.1 Due Date<\/b><\/strong>
                      Unless otherwise agreed, full payment is due prior to the Activity start date, by the deadline in the booking confirmation.<\/p>

                      6.2 Payment Methods<\/b><\/strong>
                      WYND may accept cards, bank transfers, and other methods, including $WYND where explicitly offered.<\/p>

                      6.3 Late \/ Failed Payments<\/b><\/strong>
                      Failure to pay on time may result in:<\/p>

                      • cancellation,<\/li>
                      • loss of reserved capacity,<\/li>
                      • application of cancellation fees.<\/li><\/ul>

                        \u00a0<\/p>

                        1. Participant Cancellations<\/b><\/strong><\/li><\/ol>

                          Unless booking-specific terms say otherwise, the following cancellation fees apply:<\/p>

                          • <\/b>Up to 90 days before start:<\/b><\/strong>50% of the total booking price<\/li>
                          • <\/b>Up to 60 days before start:<\/b><\/strong>75%<\/li>
                          • <\/b>30 days or less \/ No-Show:<\/b><\/strong>100%<\/li><\/ul>

                            7.1 Notice Form<\/b><\/strong>
                            Cancellations must be submitted in writing (email sufficient). The decisive time is when WYND receives the notice.<\/p>

                            7.2 Rationale<\/b><\/strong>
                            These fees reflect operational commitments and limited capacity.<\/p>

                            \u00a0<\/p>

                            1. No-Show, Late Arrival, Early Departure<\/b><\/strong><\/li><\/ol>

                              No refunds for:<\/p>

                              • No-Show,<\/li>
                              • missed transport connections,<\/li>
                              • late arrival,<\/li>
                              • early departure,<\/li>
                              • partial participation for personal reasons (including illness), unless mandatory law requires otherwise.<\/li><\/ul>

                                \u00a0<\/p>

                                1. Rebooking, Credits, and Goodwill<\/b><\/strong><\/li><\/ol>

                                  9.1 No Automatic Right<\/b><\/strong>
                                  There is no entitlement to rebooking\/credits.<\/p>

                                  9.2 Discretionary Options<\/b><\/strong>
                                  WYND may, at its discretion, offer:<\/p>

                                  • rescheduling, or<\/li>
                                  • a credit for a future Activity.<\/li><\/ul>

                                    9.3 Credit Rules<\/b><\/strong>
                                    Credits:<\/p>

                                    • may be non-transferable,<\/li>
                                    • may expire,<\/li>
                                    • are not cash equivalents,<\/li>
                                    • may be subject to price differences.<\/li><\/ul>

                                      \u00a0<\/p>

                                      1. Changes or Cancellation by WYND<\/b><\/strong><\/li><\/ol>

                                        WYND may modify or cancel an Activity due to:<\/p>

                                        • safety considerations,<\/li>
                                        • force majeure,<\/li>
                                        • minimum-participant thresholds,<\/li>
                                        • technical\/logistical constraints.<\/li><\/ul>

                                          If WYND cancels, paid amounts for the cancelled Activity are refunded. Additional compensation is excluded unless mandated by law.<\/p>

                                          \u00a0<\/p>

                                          1. Force Majeure<\/b><\/strong><\/li><\/ol>

                                            Force majeure includes severe weather\/sea conditions, pandemics, war, strikes, political unrest, and government\/port authority actions. WYND is not liable for delay\/non-performance caused by force majeure.<\/p>

                                            \u00a0<\/p>

                                            1. EU Consumer Withdrawal Rights<\/b><\/strong><\/li><\/ol>

                                              For leisure services on specific dates\/periods, statutory withdrawal rights are generally excluded by law. WYND Activities fall under this statutory framework.<\/p>

                                              \u00a0<\/p>

                                              1. Chargebacks and Payment Disputes<\/b><\/strong><\/li><\/ol>

                                                Unjustified chargebacks may result in:<\/p>

                                                • immediate suspension,<\/li>
                                                • recovery of costs,<\/li>
                                                • exclusion from future bookings.<\/li><\/ul>

                                                  1. Governing Law and Jurisdiction<\/b><\/strong><\/li><\/ol>
